Legal Question in Criminal Law in Michigan

searched for shoplifting, found drugs

a friend was accused of shoplifting

last night at a local store (meijer) and

when the police searched him they

found a stolen video game and also

heroin on him (small amount). he

was arrested then sent home.

the drugs were not in plain view and i

was wondering what kind of sentence

he could get. is there anything

protecting him because he was

originally not suspected of having

drugs on him?

Once arrested, the police have the right to search. Your boyfriend is facing serious trouble; a felony drug charge and misdemeanor retail fraud. The felony drug charge could result in prison time. I recommend hiring an attorney who may be able to negotiate with the prosecutor and keep this from ruining his record. Being convicted of both crimes he could have a felony conviction on his record for the rest of his life.
