Legal Question in Criminal Law in Michigan

sex offender expungment?

when i was 19, i was convicted of a csc 2nd degree on a 14 year old female, i was sentenced to a year in jail and 3 years probation, and 15 years on the registry, i am now 23, have been off probation for about a year now. completely fulfilled every requirement, the girl is now 19, and we are really good friends, is there anything she can do to help? can i get my record expunged? and how would i go about doing that? and would i still have to register?

Re: sex offender expungment?

You can only get certain felonies expunged once the conviction is 5 years old, and if you don't have any other convictions (along with several other requirements).

To get off the registry, there are certain crimes where you can't be removed from the registry (such as CSC 1). You need to hire a lawyer to review your file and determine if you at least eligible now for the registry removal, and then in another year for expungement. You only have 1 shot at getting your record expunged, so you have to do it properly.

And yes, whenever someone tries to get their name off the registry, the court will contact the victim to ask their thoughts on it, so having her as favorable to your request would highly increase your chances of having to no longer appear on the registry.

If you decide to retain a lawyer to pursue this, please contact me to discuss the fees.

Thanks.
