Legal Question in Criminal Law in Michigan

shoplifting

I was caught shoplifting on saturday. The officer let me go and gave me a ticket to go to court. This is my first offense and I have never been in trouble with the law ever. I am a 4.0 student and I have a 15 month old daughter. I just turned 17 and I am in 11th grade and I am graduating early. Whats the worst that could happen to me? Will I go to jail. Please give me answers.

It is possible for the judge to send you to jail if you are convicted. An experienced and aggressive attorney might be able to keep this off your record and keep you out of jail. It would be terrible going through life with this criminal record. I strongly recommend that your parents get in touch with a tough attorney right away. Relax - you're not going to jail. You're charged with retail Fraud III and , in the worst case, you will receive probation. You may also plead guilty under the Holmes Youthful Trainee Act (HYTA) which will keep you from having any record of this offense if you behave yourself.

You may soon be receiving a letter from the store or its attorneys demanding that you pay them $200 as a civil cost.

Many of my clients refuse to respond to this letter and suffer no adverse consequences. It has nothing to do with the RF III charge.

If you cannot afford an attorney, the court will appoint one for you. Ask for one at your arraignment. DO NOT not plead guilty until you get HYTA or an advisement plea first.
