Retail Fraud 3rd degree applies when less than US$200 of merchandise is stolen while a store is open for business. The max penalty is up to 93 days jail and/or $500 fine. Restitution for the merchandise is also mandatory, unless it was recovered/returned without damage.

The judge will be influenced by any other criminal convictions. If you have none, it's possible you'll get just a fine with no jail time.
