Legal Question in Criminal Law in Michigan

I signed a retainer with a lawyer and gave him 1000.00 down. Now he keeps postponing my court date because he says he is unavailable for the dates that the court sets for pretrial. If i decide to fire this lawyer does that mean that i would forfeit my thousand dollars?

No. He is only permitted to take out of the $1000 an amount for the services rendered thus far on his hourly fee. The remainder should be returned to you.

You have to read the written retainer agreement carefully (if you have one). You could get a partial return of your money, however, if you he has not done any work for you and you're not happy with his services, you can ask for the return of all your money. Why is adjourning your matter affecting you or impairing your matter? Perhaps there's a startegic reason behind it. It is not uncommon for attorneys to adjourn court dates. You should talk to him and see why he keeps adjouring it. Ask fo his cell phone number or e-mail him directly. It is a good idea to get this in writing now before you encounter problems later.

You have some sort of contractual agreement with your attorney. So long as the attorney fee is reasonable, the agreement with the attorney will determine whether you are entitled to get money back.You should have a frank discussion with your lawyer right away to try to resolve your concerns.
