Legal Question in Criminal Law in Michigan

My son is 10 and him along with 2 other boys, bullied a 8yr. girl, sexually by pulling her pants down,pulling her hair, showing them selves to her, touching her bottom, and chest. Took place on school playground & their is a viedo tape of the boys that came aganist this youg lady. the other boys ages are 12 and 13 1/2. what will the charges be against my son and what is the worst that can happen? How should I handle this matter ?

You son could be charged with criminal sexual conduct 2d for improperly sexually touching another person under the age of 13. Depending on the county you are in, your son may be lucky enough to get into a juvenile sex offender program that results in no sex crime on his record and no need to register as a sex offender. Yes, this could get very messy. I also recommend, if he is charged, to request that he be evaluated for competency. It is quite possible he will not understand what the court procedures are all about. What county are you in?

You should handle this by not speaking to police, detectives or other governmental authhorities, including school officials without the presence of an attorney. CSC cases are best handled during the pre-charge stage. It is at this stage where the prosecuting attorney determines whether or not they have enough evidence to bring charges against someone.
