Legal Question in Criminal Law in Michigan
My son is being charged with a crime he did not commit. He is being charged with conspiracy to larceny a building to steal a firearm and larceny of a building to steal a firearm. He was in the wrong place at the wrong time with the wrong people. My son is 15 years old and has never been in any kind of serious trouble. The kid who blamed it on my son is 17 and has a record a mile long and knew he would serve a lengthy time in jail.My son has never spoken to the police,detectives, or anyother member of law enforcement regarding this situation. We simply recieved a letter via mail to appear in court for a pretrial. In the mean time, another childs probation officer(who doesnt even know my child by the way), told this other childs parents that my son was nothing but bad news, told them everything that they are accusing him of, exactly what his charges are, and even when his court date is. Is this legal? My son was never found guilty of anything. What happened to innocent until proven guilty? Not to mention he is still a minor.
