Legal Question in Criminal Law in Michigan
My son was convicted of violating MCL 750.145d2d which is not currently a listed offense that he would be compelled to comply with SORA. His Judgment of Sentence does not mandate that he register. MDOC, however, seems to think that registering is part of his sentence and has listed it as part of his parole conditions so he has registered. Does MDOC have the authority to make him register even though it's not a listed offense AND not part of his sentence? If not, how does he go about getting off the registry?
