Legal Question in Criminal Law in Michigan
My son and his friend came across stolen property and moved it. His friend has been charged with possession and has a court date within the next 5 days. Is it possible for the posecuting attorney to charge one of the boys and not the other. The friend has a list of troubling court appearances and my son has never been in trouble. We haven't heard anything from law enforcement or the courts since he was initially questioned.

The prosecutor has complete discretion about who to charge. They can charge one person and not the other.
