We cannot answer this question without a lot more facts. The sentencing guidelines factor in things like prior adult and juvenile felony and misdemeanor records, whether the person was on probation at the time of this crime, whether there were more than one count / crime being sentenced at the same time, ... plus case-specific details that are too numerous to go into here.

Attempted CSC2nd is a Crime Against a Person, and would be an "E" class crime. (CSC2nd is normally a "C" class felony, but as an Attempt it's dropped down to an "E").

Review the instructions and definitions chapters, the open up the Crimes Against a Person chapter and go through the Prior Record Variables and total up all the PRV points that apply. Do the same for the Offense Varialbes and total up the OV points.

Then open the "Grids" file ... go to the page for "E" class felonies ... apply the PRV total points along the top line, and the OV total points along the left edge. Where the column and line meet, that's your guidelines range.

The maximum penalty for CSS second degree is 15 years. We have never had a client sentenced to 15 years for that crime. We have EXTENSIVE experience defending against those charges.
