Legal Question in Criminal Law in Michigan

My son rides a public bus paid for by his special ed school he is 3 and a half autistic and can not talk. His bus aide was busted sexually assaulting other male students on the bus. Like I said my son can not talk to say if he touched him or not. My question is can I sue the bus company for putting my son in that position?
