Legal Question in Criminal Law in Michigan

Some specifics on alcohol hosting/providing for a minor

How does a prosecutor attempt to prove that alcohol was provided for a minor? Does my presence, as an of-age drinker, make me responsible for any and all alcohol consumption near me? How does that work? Thanks.

Re: Some specifics on alcohol hosting/providing for a minor

The statute reads that an owner, tenant, or any other person having control over any premises, residence, or other real property shall not knowingly allow a minor to consume or possess an alcoholic beverage at a social gathering on or within that premises, residence, or other real property. Having said that, the prosecutor must prove that the offense was committed "knowingly." In other words, if you were asleep the whole time, he has a proof problem. The most likely scenario in cases like this is testimony from witnesses. Hope this helps you.
