Legal Question in Criminal Law in Michigan

My stepson pushed me in my home and I pushed back and warned him not to do it again. He did so I put him in a headlock and took him to the ground where I held him until he stopped struggling. He filed assult charges against me. Am I wrong or do I have the right to defend myself in my own home?

Self defense might be available to you as a complete defense. However, this can only be determined after your attorney learns all of the relevant information. You should read more at:

Michigan has a self-defense statute that states in pertinent part:

(2) An individual who has not or is not engaged in the commission of a crime at the time he or she uses force other than deadly force may use force other than deadly force against another individual anywhere he or she has the legal right to be with no duty to retreat if he or she honestly and reasonably believes that the use of that force is necessary to defend himself or herself or another individual from the imminent unlawful use of force by another individual.
