Stolen Property / Use of Marijuana

My 17 year-old daughter accepted $300 from another girl who stole the money from her mother. She never spent any of it and gave it all back after being called by the police. She obviously knew that it was stolen. Now she is being charged with receiving stolen property. What can she expect to get for a sentence for this. She has also been charged with use of marijuana. Apparently during questioning it came out that all the kids involved were smoking pot. They made my daughter give a urine sample and it came back positive. Should we hire an attorney?

Your daughter is no longer a juvenile and is faced with two misdemeanors - each with a maximum penalty of 93 days in jail and up to $500 fines plus costs. Her driver's license would also be suspended.

If she has no prior criminal record, it is unlikely that she would have to serve any jail time if convicted. But you may be concerned that the convictions will be entered into her permanent record which will hamper her ability to get into a good school or obtain employment.

An attorney can keep these events from being entered into her record and would be likely to get one of these charges dismissed altogether. Her license would not be suspended.

Your daughter may be charged as an adult. She is looking at two misdemeanors both carry maximums of 93 days in jail and $500 fines. An attorney can help keep her record clean.
