Legal Question in Criminal Law in Michigan

sue for defamation of character and mental anguish

I got accused of stalking my sister in law which resulted in me being arrested and going to court. I was proved innocent because I never commited this crime. She falsely accused me and I was never informed by the police station that I was being accused until I got pulled over by police and went to jail. This court stuff went on for about 5 months and as a result I had to seek couseling for stress and was told that i have a generalized anxeity disorder and have to take medicine because of the stress. My husband is also being accused of the same thing which the phone records show that he did not call and harrass her. He might face possible jail time or fines for falsely being accused . can we sue her for defamation of character and mental anguish? The police officer who took her statement never asked her for phone records proving any harrassment. and I was never notified by police that I was harrassing and to stop ( even though I wasn't).

Re: sue for defamation of character and mental anguish

You have a right to sue, but it would be difficult to find an attorney to take this case.

If your sister in law was collectible it might be worthwhile.
