Legal Question in Criminal Law in Michigan
Suspect in shooting is innocent
I was dropped off at an area not far from where apparantly a shooting happened. It was night time, i wanted to rondevous with a female at the local bar. She wasnt there so i began to walk to my friends home not far from the bars location, i heard two loud bangs that sounded more like fireworks to me when withing 20 seconds or less another person ran threw a yard, the person threw something down curious for several reasons as i approached the spot i stuped down picked up a very small item which in a second i identified as a small caliber daringer pistol( very small) i was apprehended up the street searched and then let go then arrested on site later that night i guess the police found the weapon they say and now a detective has called me and asked for an interview tommorow i have given no previous statement or admission of any guilt i took the fifth. The detective tells me they have a finger print match on the weapon which doesnt shock me. I had no gloves when i was walking. I dont know the victim nor does the victom know me. It has been almost two weeks since the incident occured. Do i give the interview? and what do i tell them simply the truth?

In my humble opinion...never talk to police. They will use anything you say against you. Remember they are doing a job, they are not there to help you. If you didn't shoot the gun, there are great ways to go about your defense. Feel free to call my office to discuss the matter further. Eric I. Kutinsky (248) 737-7000
