Legal Question in Criminal Law in Michigan
Swearing in process
I am just curious about the swearing in process that occurs at the beginning of all court proceedings. Does anyboby really believe that this will prevent the people involved from lying? or is it just some time honored tradition? I guess I just dont understand the the reason for it.

No attorney can answer for what everybody or anybody and what they would think. However, most of us like to believe that there is some integrity left in people and that they take enough pride in themselves to not be liars and cheats. If they don't have that pride, perhaps they will be intimidated into not lying in court by the threat of going to jail or prison if they get caught. Swearing to tell the truth is a necessary prerequisite to testifying because lying after taking an oath to tell the truth constitutes perjury.
