It is impossible to tell exactly what a prosecutor might charge you with. There are several offenses that they could choose from. If you are charged, do not make an statements at all to police or anyone else. Instead, get a tough, experienced attorney on your side.

Re: theft

Could be misdemeanor Retail Fraud 2nd Degree (because the item value was between $200 and $1,000) ... but if you have a prior Retail Fraud or Larceny conviction, the prosecutor could charge you with a felony: Retail Fraud 1st Degree. If you committed an assault against LP in order to get away, a prosecutor could charge you with Unarmed Robbery instead of Retail Fraud ... a much more serious felony.
