Legal Question in Criminal Law in Michigan
theft,extortion
My son is night supervisor where he works. He got to work Sunday night and the safe was open.He called the police. They questioned a few people.Today he had an appointment with the detective on this case.He was not worried when he went.He is now.He was questioned for an hour and a half. The detective tried to get him to admit he did it.The detective said his credibility is bad because someone told him he was cheating on his girlfriend he lives with and saying he was at work on his days off.His boss even threatened to call his girlfriend and tell her. They live together but he has wanted to leave but hates to because of his daughter. The detective said this makes him look bad. When the interview was over he told him he was NOT cleared as a suspect and may be asked back for a lie detector test.He cannot afford an attorney. He was suspended without pay until they figure out who did this.Everyone that knows him and works with him does not think he would do such a thing, except for his boss.Should he be afraid? We all hear of innocent people going to jail.

He should not talk with the police any more and under no circumstances should he agree to take a polygraph without first talking with an attorney. It is very important that he talk with an attorney now. Many attorneys will consult with your son during the prefile stage for not a lot of money. If the case is later authorized your son may be entitled to a court appointed attorney or a public defender (depending on the jurisdiction). Your son is looking at serious charges which if he is convicted of can cause him to be incarcerated for quite awhile, depending on his prior record, if any. Good luck.
