Legal Question in Criminal Law in Michigan

First time offense for retail fraud by a 17 year old and 2 18 year olds, all gir

We took some makeup and got caught and arrested. The total amount stolen was barely $25. Now we have to wait for the courts to send us a court date. What we want to know is, what can happen to us when we go to court. This is the first time any of us has gotten arrested and we're scared and don't know what the possible outcomes are. PLEASE HELP!

First of all try to relax. What happens to you will depend on the County this occurred in. Normally first time offenders will not be sentenced to jail time. It is possible to have the matter taken under advisement which is a probationary term after which, if successfully completed, the case will be dismissed. If that is not an option your attorney might be able to arrange a plea where each of you are sentenced under the Homes Youthful Trainee Act. If this is the case then after successful completeion of probation the matter is dismissed and no public record is kept of the crime. In effect you have no criminal record. You should probably have an attorney represent you in this matter. Provide me with the City and County and I can give you a better assessment of what the possible outcome will be. Be advised, however, that no attorney can tell you what the actual sentence will be as that is the function of the judge unless there was a Killebrew agreement and the judge signs on to it. Good luck. If you have further questions do not hesitate to give me a call at my Lansing Area Office, (517) 699-5090 or my Detroit Area Office (810 463-5821, or post another query to lawguru.
