Legal Question in Criminal Law in Michigan

Uttering and Publishing

In 1991 I was convicted of Uttering and Publishing, I was sentenced to 750$ in restitution and 6 months of probation. I was told that the charge was a misdemeanor and would not affect my rights (voting, guns and the like) in fact MI issued me a CCW in 1999, I have since moved to GA and have applied for my GFL and they are questioning my eligibility due to this charge. My question is: How can I have a Felony that is punishable with 14 years in prison and have been approved for countless firearm purchases, a MI CCW as well as many senstitive security clearances for work? What can I do do get this charge removed from my record? Thanks

Re: Uttering and Publishing

Assuming this is your only conviction ever for anything, you can move to set aside the conviction in the Court it happened in. I have been extremely successful in these matters. Visit www.kliszlaw.com to discuss further. Tim Klisz

Re: Uttering and Publishing

Uttering and Publishing is a 14-year felony. So I don't understand when you say you were told it was a misdemeanor. Either way, you can petition the court to set it aside since it was 2 centuries ago and you've been clean since. You can contact us to help you with this matter. 248.865.4700 Daniel Hajji

Re: Uttering and Publishing

You can apply to have the conviction set aside or expunged. The application is filed in the court where you were originally convicted. As for the gun permit situation, eligibility varies from state to state. Your best bet is the expungment.
