My daughters were sexually assaulted by my father. He was sentenced to prison a number of years ago, but will be eligible for parole later this year. I have recently recieved information that his sister who died in 2001 left him an inhieritance. I feel my kids have a right to that money. They have suffered greatly and probably will the rest of thier lives. Do I have any recourses here? I believe he was ordered at the sentencing to pay retribution but of course at that time he didn't have 2 nickels to rub together. I don't even know the amount of his inhieritance, but am looking into getting a copy of probate records from the state she resided in. Any help would be greatly appreciated.

Your daughters may sue him for assault and battery and recover civil damages. I had such a case which went to trial in 1999 and the judgment was substantial. You did not say how long ago he did these acts, and that would my single concern at this point - that the time in which to sue him has expired. I would be willing to discuss this with you in detail. Your daughters may recover substantial damages against your father. I will give you a clearer understanding of their recovery if you can tell me how old your daughters are now. Next, I need to know the approximate date(s) they were assaulted.

It would also be helpful to know the crime(s)for which your father was convicted and the year of conviction.
