Legal Question in Criminal Law in Michigan

violation of probation on record sentenced to PA511

Having absolutely no priors with any law enforcment agency or courts, I plead no contest to an embezzlement charge in 97 received delayed sentencing and in 98 was given 5 years probation and did 2 wks in county jail. In Aug of 2000 was sentenced to PA511 for violating probation, servied less than 90 days in jail along with a 90 day treatment program (which I completed and had no violations)and then I was ''discharged with out improvement'' in Oct 2003. I am in the process of a 7 year criminal background check for employment purposes. I have not committed any new crimes in that time period. Will the violations show up as felony convictions? Basically, how will this effect the check. They are using OCISonline.com I have previously passed 3 other employment background checks 2 in Michigan in(2004) and then I had one done out of the state of Illinois (for Michigan) and passed. Also, I received a voter registration in Michigan and one in the state of Texas (where I live now). The county prosecuters office shows nothing, but the county clerk court services shows the whole thing, payments of restitution, violation ''conviction'' for 2000 and shows ''convicted of Violation of Probation - discharged without improvement''

Re: violation of probation on record sentenced to PA511

You are eligible to have your record expunged in October of 2008. Until then, it's likely that the embezzlement stays on your record.
