Legal Question in Criminal Law in Michigan
my wife was recently charged with assault and battery in a completely frivolous charge. The presiding judge said it was the weakest case he has seen in thirty years on the bench. My wife was acquitted and her record expunged however she was put through seven months of hell! Can we sue the prosecutor as well as the person bringing the charge?

Certainly not the prosecutor. They have immunity. You can possibly sue the accuser, but they would have to be collectible, or its simply not worth it.
