I worked at a store and took $40. Can I go to jail? How long and what will happen to me?

Did you get caught? Did anybody see you or is it on video? Have you confessed to the police? If there is an actual criminal charge brought against you, it will depend on how the Prosecutor may change you. Likely it will be charged as a misdemeanor larceny under $200, which is a 93 day maximum/fines/costs/and/or probation. Likely with no prior record, you could receive a plea agreement of no jail, or even a delayed sentence to keep the matter off of your record after successful completion of probation.
