Legal Question in DUI Law in Michigan

2nd OWI in Michigan

My brother just got his second OWI. They put him in a two person cell with eight other people. After 7 hours, they agreed to let him out if he waived his right to an attorney and pleaded guilty or stay 24 hours. It was an eye opener seeing people thrown against the wall for talking. This was so bad he saw his chance to get out and he took it.

He lives alone in a trailer out in the middle of nowhere. He is losing his drivers license for one year. There is no transportation available. He makes minimum wage. He has to drive a distance to get to work. There is no one who is available to drive him. He is a bit of a hermit. My mom and I are the closest to him, but I only see him once a year.

He cant ride a bike because he had a heart attack a few years ago and only has 25% of his heart. We thought about a moped but winters are harsh and he cant get a license since you have to have a drivers license to get one even though it is 30 mph or less.

His parole officer did not give him any options. I remember someone who got a restricted license. Also, I dont think that what the Kent County jail did was legal. Is it really too late for him to get a lawyer?

Re: 2nd OWI in Michigan

It's not too late to get a lawyer, but it would be more complicated and expensive now that it is after the fact.

whether or not he qualifies for a restricted license depends on the terms of his suspension and probation. If you need to hire a lawyer, please contact me, as I have a very good friend who specializes in drunk driving and license restoration law. He is very aggressive and would be able to assist you.

Thanks.
