Legal Question in DUI Law in Michigan

breathalyzers

If I am a passenger in a car am I required by law to give a breathalyzer if I am asked to, even if there is no physical evidence of alcohol in the car? Also is it the same if you are a minor?

Re: breathalyzers

If you are a passenger in a car you are criminally responsibel for driving under the influence. However, if you are a minor and the police find open alcohol, or a minor in possession of alcohol, there may be other ramifications. Please call me at (586) 402-0242 so I may discuss this matter with you.

Re: breathalyzers

Greetings; The rules are quite different for drivers and passengers. As a passenger, you are NOT required to answer any questions or take any tests. (period) The police have the right to only identify you....nothing more. There are NO exceptions. Please visit www.trichler.com for further information and answers to fAQ. Thanks. Atty. Trichler.
