I was involved in a dwi accedent (no victim)with perscription drugs in my system . At the hospital the police SAID... They asked for my consent to test my blood and I gave it . I don't remember honestly , I was heavily sedated . considering my mind state , is my consent to the police to check my blood even valid should I deny I gave it . With out police properly assertaining this evidence can I get it thrown out .

Re: consent to draw blood

You are not privileged to give consent under Michigan's implied consent act, i.e., by operating a motor vehicle, you are obligated by law to submit to a blood test if the officer has probable cause to believe that you were driving under the influence.

You need a lawyer to to help you out. You may have other defenses.
