Legal Question in DUI Law in Michigan

DUI not seen driving the car

I am on probation for a DUI 3rd and I got a flat tire and was on a side street with no traffic on the street. I know that I was getting more drunk so I called my wife to come and pick me up I planed to fix the flat and leave the car. A police officer pulled up behind me and questions me I told him that I ran over something I was charged with a DUI and took to jail. My arrived on the seen about 2 to 3 minutes after the police did. He stated in his police report that there was an accident and there was no damage to my car but a flat tire. Also I was not in the car or the keys were not in the car. I have a lawyer and I wanted to know what I should make sure that is covered in this case. I could go to prison if convicted and need to know everything the can be fought in this case.

If you have a lawyer, why don't you ask him for the answers to your questions. If you don't think he is competent, maybe its time to get a new lawyer.

Re: DUI not seen driving the car

When you admitted to the officer "I told him that I ran over something", he doesn't need further proof that you were driving drunk and that you caused the accident.
