Legal Question in DUI Law in Michigan

Dui

A family member proceeded through an accident scene as there were no police to direct traffic. He was pulled over and the officer smelled marijuana. I understand he was ticketed for going through the scene and I'm not sure about the marijuana except he handed the small bag that he had over to the police. No priors of any kind. Please advise if I should hire legal cousel for my family member or if the courts are fairly lenient (no jail) for this crime.

Assuming you are living in FL and your family member remains in MI, you should get be clear on whether he was arrested for driving under the influence of drugs. The limit for marijuana is quite low in Michigan.

But, if he was only ticketed for possession, he will not go to jail but he will have a record and his license will be suspended.

If he wants to avoid this, he can get an attorney who can keeep his record clean and will keep him on the road.
