DUI before Heidi's Law in MI

Heidi's Law passed in Jan 2007 changed the lookback period to lifetime. Is a DUI conviction before that date subject to the new law? Thanks.

Well, it depends. If a person is charged with 3d offense drunk driving and the prior offenses are within the last 10 years, then yes, clearly. If, however, the prosecutor is trying to use convictions more than 10 years before the law took effect, there are some constitutional challenges that can and should be made.
