i recently got pulled over for o.w.i. because of improper backing [i live on the corner house] three blocks from home and was arrested. i tried to blow at the station and was given a technical refusal despite asking to let me try again. now i have 2 issues to deal with. Also no blood was drawn. do i have any chance?

YES YOU DO!! But you need to contact us immediately!! You wil lose your license in 14 DAYS if you don't request a hearing within 14 days of your arrest. Also, if there is no blood or breath results, the prosecutor may not know your blood alcohol content. Yes, you do have a chance, however, I have to know what the circumstances were surrounding your arrest to determine if there was a proper stop. Secondly, I have to know whether you were offered a field sobriety test. I need to talk with you immediately to assess your chances. I look forward to helping you in this matter.

You have a date with the Hon. Roger J. La Rose in the 32A District Court, in Harper Woods.
But, before that, you should appeal your "refusal" to take the Datamaster to the DLAD. The appeal application is on the back of the second sheet of paper you received (beside your temporary license) when they took your picture license. You must mail this appeal within 14 days of your arrest or your license will be suspended for one year.
If you took the breath test in the car, the result should be noted on the ticket you received. It's in the upper right hand corner. I'd like to know what it is. You must have taken the PBT because otherwise they would have taken you for a blood test.
