Legal Question in DUI Law in Michigan

I'm sober now and learned my lesson the hard way. I'm trying to reinstate license. I may have to do time in jail to do so. Back in 1998 I recived a dwi on a 1978 Suzuki RM 50. I was on a dead end road out of city limits. I checked Suzuki records and the actual size of the motor was 49cc. The officer told me that if it wasn't 50cc of over the small dirt bike wouldn't be concidered a motor vehicle. Now the law has changed. Can I still appeal this redicilos ruleing after the definition of a motor vehicle had been changed?
