Legal Question in DUI Law in Michigan

I have a friend who was stopped by police while walking a friend home in a college apartment complex. The officers did not breathalyze him and wrote him an MIP. What are the chances of him getting off clean at his court date?

You mean he's actually innocent? Well, this must stop!

Oh, wait! Was he actually a drunken minor having ingested a great amount of alcohol who refused the breathalyzer and gave the officer a lot of attitude?

Or, the usual is explained as:

A breathalyzer result is just one piece of evidence. Your friend's other behaviors are also evidence. The most common of which is his affirmative answer to the officer's inquiry "Have you been drinking (alcohol)? If his answer is "Yes", a breathalyzer is unnecessary. His admission is enough.
