Legal Question in DUI Law in Michigan

can you go to jail for an open intox misdemenor. My boyfriend got a ticket for open intox while i was driving. I got pulled over and he received the ticket.... The Clerk said he could possibly go to jail because the magistrate rarely gives out fines for this offense. If he does have to go to jail how long can they sentance him... he was only the passenger
