Legal Question in DUI Law in Michigan

Marijuana possession

I was caught with a pipe and some shake while driving a commercial vehicle (truck). Will they take my license? If they didn't give me a ticket at the time, can they still press charges?

Re: Marijuana possession

Losing your licensing because of something like this could happen either of two ways. First, the secretary of state has the discretion to revoke or suspend a license based on information it gets from courts. If you are given arrested for DUI, for instance, the trial court will report this to the secretary of state and they can act according to statute to suspend or revoke. Since you were not issued a traffic citation, it doesn't sound like this would happen in your case. As far as pressing charges against you, that would still be a possibility.

Re: Marijuana possession

The answers to both your questions are "probably yes, unless you beat the case." This is especially true if you have a CDL but even a regular license will probably get suspended.
