Legal Question in DUI Law in Michigan

MIP or drunk in public?

I was given an MIP this past weekend while waiting for a taxi at around 2 in the morning. I've been told to fight the MIP charge because I did NOT have any alcohol containers on my person, however I was intoxicated. Is this a good/ logical idea under the circumstance or should I just pay the potential fine at my court hearing?

Under MCL 436.1703, the statute proscribes a minor from purchasing, possessing and consuming alcohol. If an officer had a reasonable suspicion that you were intoxicated and you had any bodily alcohol content, you could be charged with a misdemeanor.
