MIP - Do we need lawyer?
My daughter recently received an MIP ticket (misdemeanor) by consumption. She was a passenger in a car that was pulled over. She was the only one in the car who had had a drink. She blew a .04. She has never been in trouble before. We have to make an appearance tomorrow. Should we have a lawyer with us? I am a single parent on a very limited income.

The East Lansing District Court sees many MIP's. The MIP statute provides that the judge may take a guilty plea under advisement for (usually) one year after which (if there are no further incidents) the case will be dismissed and no accessible record is ceated. There is no jail for the first offense and the maximum fine is $100.
However, the advisement period has a monthly charge. If you have a limited income, be prepared to show the court proof of your inability to pay.
