Legal Question in DUI Law in Michigan

Obtaining a new license in different state

I received 2-DUIs during the begining of my sophomore year in college, year 2004. My license was revoked since then. I have been paying money to the Driver's Responsibility and waiting for my license to be returned.

I have since now graduated from college and am looking to start a job in another state. For this new job, I will need to drive to and from work, and during trips.

Will I be able to obtain a new license in a different state such as New York or Kansas? I am wondering if the ''Interstate Driver's License Compact'' and ''Non Resident Violator Compact'' will work in my favor. I have read about these, and since Michigan is not part of the compacts, there might be a glimmer of hope.

I am not looking to escape from Michigan's driving laws, but to simply be able to work in the mean time in a different state while I pay off the remaining debt and wait for the allotted time to regain back the license.

Re: Obtaining a new license in different state

Although I am not licensed to practice law in the other states you mentioned, I CAN tell you that I am not aware of any state that will issue a license for a driver with a revocation in another state. Most states will honor another state's disciplinary action taken.

Whether you can institute a proceeding to reinstate your MI license via another state, I would expect that not be the case since each state is an equal sovereign as to its own laws but maybe someone else here will say I'm wrong.

In my view, the easiest way to proceed is in MI regardless of what you *might* be able to do elsewhere. I'd recommend commencing your action as soon as you're eligible, preferably before you leave if possible. You might be able to get at least a restricted before it's time to move.

I can assist you with this but would need more information about your convictions. Please feel free to contact me for a free consultation.

Re: Obtaining a new license in different state

You will not be able to get a license in a different state unless you receive a "clearance." Because you have 2 DUIs within 7 years your license was REVOKED. You can not get it back unless you appeal to the DLAD. That means you will not automatically get it back. Call me to help you with that 5862851700
