Legal Question in DUI Law in Michigan

OUIL and MIP is this a parole violation?

I recieved a OUIL on 01/01/00. I am now on probation for 12 months. I have payed all of my court and offense fines and probation fines and community service hours are taken care of also. On 06/22/00 I was driving with a friend of mine after having About 2 glasses of wine. I was not driving and was also sleeping while she was driving all around town trying to find her lost wallet. She for some unknown reason was driving 65 mph in a 35mph zone and ran 3 red lights. Needless to say we were pulled over. I was for the most part tricked into taking a breathalizer were I then blew a 0.06. What are my repercutions going to be? Is there a chance of me going to jail and if so for how long? Thank you.

Assuming that refraining from alcohol was a condition of your probation, this could be the basis for a probation violation.

I would think that in light of the circumstances and the fact that you have substantially completed all other terms and conditions of your probationary sentence, jail is not likely. HOwever, many judges will extend your probation.
