OWI charge
My 22 year old daughter has been a full time student for 3 years. She is in her final. She was at a local restaurant with friends for a birthday party. She had 2 drinks and was on her way home. She was pulled over for a taillight problem and the officer had her do breathalizer test. She failed. She
hired a lawyer to represent her in court but he was not that great.
She was fined, community service and has this on her record. She has no criminal record, excellent driving record, etc. How can this happen on first offense. She claims the responsibility and is doing her part but she is having hard time getting jobs now. They do background checks. Can she get this exsponged..or appeal.
Please help.

She cannot expunge a drunk driving case in Michigan.
This is one of the dangers of hiring a cheap / inexperienced / lay-down type attorney.

Believe it or not, that is typically what happens on a first offense conviction. That's one of the big reasons that you have a lawyer that you are sure is doing everything possible.
To answer your other questions, state law prevents OWI's from being expunged and the appeal period ends within 21 days of sentencing. It sounds like she may be out of luck there.
