I swerved to miss a deer at 11:00p.m. and went into the ditch, no damage to the car I was not hurt. I went out drinking after I also called the police and reported this. the police came and found me and did a breath test at 2:20a.m. now they are trying to charge me with owi and failure to report an accident. There was no damage there was no accident. I have three witnesses that say i did not appear intoxicated. What are my chances of winning this case?
