Legal Question in DUI Law in Michigan

I received a dui in North Carolina when I got out of the service back in 1996. I subsequently received another one in Michigan in 2000. The judge gave me a first offense because case law showed that North Carolina's law was stricter than Michigan's and thus the North Carolina law could not be enforced as a first in Michigan. My problem lies within the fact that the Secretary of State does not differientate based on the Law. Do I have a case that could be taken to Circuit Court and won? I have gone the SOS required route and was denied and am now in a position of wanting to hire a lawyer but did not know if this would be a case that would even be considered, because of the length of time since the offense occured.
