My son was hit by an off duty police officer whose blood alcohol level was over .175. Over two months later he was not charged. My son has a closed head injury and has not been able to return to school because of the injuries that he Can the officer be sued for negligence? I am concerned because he has not been charged and apparently the prosecutor is making light of the officer being so drunk and driving. Lately there seems to be an epidemic of officers driving drunk and they should be the ones setting the example.
