i was on state land and had an open intox in the truck. (can of beer) i did not recieve a pbt the cop just gave me a open intox in a motor vehicle. i currently have a m.i.c on my record and i used up my 74/11 on a drug charge. what kind of penalty can i get for this? as in fines/probation/jail? im wondering what to expect.

If you're on probation and still a minor, could be a full 90 days.
You could receive a maximum of 90 days in jail and if you're currently on probation, any guilty plea could result in a probation violation and you could be sentenced to the maximum on that crime, as well. If you're under 21 and a judge sees fit, though I find it unlikely, he could take a plea under the Holmes Youth Trainee Act and then you would not have a conviction. http://www.wolverinelaw.com
