uderage drinking

I heard that an officer cannot give you an mip unless you are driving or if you have alcohol on you, and you can refuse the breathalizer, and i heard this was passed by judge lawrence. is this true

You heard wrong.

Yes, you can refuse a breathylizer but you will be issued a civil infraction for refusing and can still receive an MIP. A breathylizer is not the only evidence that will support an MIP.
