Legal Question in DUI Law in Michigan

My son was arrested and spent the night (actually the day) in jail. He was found in a church parking lot passed out at 5 am. He took the Breathalyzer and registered .15. He has a court date on 1/30/08 and was released to me today. He did not get his license back. My question is what happens now. Will he not get his license back until his court date? How much is a typical fine for this type of offense? He has no record of drinking and driving prior to this arrest.

The fact that they destroyed his picture license that night does not mean he is already suspended. If he had a valid license at the time of his arrest, he still has a valid license today. He should have been given a 'temporary license' after booking was complete. *IF* he pleads to a charge, then he may be suspended or restricted, but not until then.

Typical fines vary from court to court, but I'd be willing to bet that it will be between $600-800.

Was he charged with zero tolerance or OWI? Fines and costs are different for each.

He should have been given a temporary license when his picture license was destroyed. Don't put his jeans in the washer until you go through the pockets.
