3 day resind of signed contract & responsibility of medical support payment if l

If a husband is laid off from work, is he still responsible for the medical portion of his sons suppport. A friend is divorced with custody of son, ex-mother-in-law offered to pay for a medical eye condition program for $1,800.00 and Sunday she brought check and had her sign that the ex-husband could then claim the son for this years taxes. She now would like to resind [isnt there a 3 day resind policy in Michigan] and return check and keep son for dependant and go after him for his portion of medical expenses, but he is laid off, will he still be responsible & can she resind?

Re: 3 day resind of signed contract & responsibility of medical support payment

The 3 day recision period only applies to door to door sales.....not this situation. While the agreement may be valid, on the other hand, there is still a court order and the father is not compling. The fahter did not go into court to have the order modified so your friend is probably in good shape. Let her take the deduction and attach the court order along with her taxes. Chances are the IRS will go with the order. Bill Stern 248-353-9400
