3rd party Discipline

I am going through a divorce, and my wife has a live in boyfriend. He has spanked my 4 year old daughter as discipline. Is this legal or can I try for a restaining order or something? He also took pictures of himself doing this.

In what county does she live? Is that the county where the divorce is filed? Have you notified your lawyer of this?

These cases are fact driven. Your posting does not have enough information to answer the question you posted. The short answer is yes, perhaps you can get a restraining order, or something. But more information is needed.

The other man should not be involved in corporeal punishment of your daughter. You can put extreme heat on your wife regarding custody as long as that guy is around plus, you may be able to obtain a court order preventing him from engaging in such acts in the future. If he violates, he'd face civil contempt with sanctions, such as imprisonment, fines, etc. William S. Stern
