Legal Question in Family Law in Michigan
35 years of marriage, then it's gone!
I was married for 35 yrs, raised to provide my family and my wife takes care of the household. I worked 80 hours a week for GM until recently. My spousal support is based on the past, GM is not working 80 hrs any longer. My support is $750.00/wk plus $130.00/wk for mortgage. All things remaining the same once she re-mortgages the house, she get $850/wk until I retire at that point she gets 1/2 my pension and SS supplement. Since my pension is cut by the SS supplement, she will get much, much less. If I take the early retirement from GM they will pay my full retirement, but since I can't draw SS yet will she get the supplement GM is paying until I can draw SS. Secondly, she apparently opened credit cards in my name to the tune of about 23,000 in addition to the cards she opened in her name for 21,000. For some reason they deem me responsible for something I had no knowledge of until the divorce. Can I file fraud/forgery charges against her. How can I get out of having to pay this? How can this be legal? Do I have any rights?

You can get the paperwork for the credit cards and see who signed, the dates, etc. Then you can decide whether to bring charges. You also will be able to get out of responsibility due to fraud. Make a motion in court to reduce your spousal support due to a material change in circumstances, unless your potential "buy-out" would prevent this. Get a good family law lawyer. William S. Stern

You have far too many complex issues to be asking a lawyer that you don't know, over the internet. Either you have a lawyer and should be asking your own lawyer, or you don't trust your lawyer. If you don't trust your lawyer, get a new one. If you're trying to do this without an experienced and aggressive lawyer, you're crazy.
